IvA Car & Bike — Terms & Conditions
1. Introduction
Welcome to IvA Car & Bike ("IvA", "we", "us", or "our"). These Terms & Conditions ("Terms") govern your use of the IvA Car & Bike mobile application, platform, and related services.
By registering an account or using our services, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, please do not use IvA.
2. Eligibility
To use IvA, you must:
Be at least 18 years of age (or the minimum legal age in your jurisdiction)
Have the legal capacity to enter into a binding agreement
Provide accurate and complete registration information
3. Customer Responsibilities
As a customer, you agree to:
Provide accurate personal and booking information
Keep your account credentials confidential
Use vehicles only for lawful purposes
Follow all applicable traffic, safety, and road laws
Take reasonable care of any vehicle booked through the platform
Pay all applicable charges including bookings, cancellations, or damages
Report accidents, damage, or incidents immediately
You must not use IvA or any booked vehicle for illegal activities, reckless driving, transporting prohibited goods, or any activity that endangers people or property.
4. Provider / Driver Responsibilities
Providers (vehicle owners, drivers, or service providers) must:
Provide accurate information about themselves and their vehicles
Hold valid licenses, permits, and legally required documents
Ensure vehicles are roadworthy, clean, safe, and properly maintained
Comply with all applicable transportation and traffic laws
Provide services in a professional and safe manner
Report accidents, disputes, or vehicle incidents promptly
Maintain insurance required by applicable law
IvA may verify Provider documents and reserves the right to suspend or remove any Provider or vehicle that does not meet our safety, legal, or quality standards.
5. Booking & Cancellation
Bookings are confirmed only once the platform displays a confirmation
Availability, pricing, and conditions may vary by vehicle and Provider
Cancellations are subject to the cancellation policy shown at the time of booking
Any applicable cancellation fees will be clearly communicated before confirmation
IvA may cancel or modify bookings due to unavailability, safety concerns, technical issues, or other circumstances beyond our reasonable control
6. Payments & Refunds
You agree to pay all charges associated with your bookings, which may include:
Rental or service fees
Platform/booking fees
Applicable taxes
Cancellation or damage charges
Payments are processed via trusted third-party payment providers. Refund eligibility is subject to the applicable booking and cancellation policy. Approved refunds will be processed through the original payment method. Processing times may vary by provider and bank.
7. Vehicle Condition & Damage
Customers must return vehicles in the condition specified at the time of booking. You may be held responsible for costs arising from damage, misuse, excessive cleaning, or unauthorized use.
Both customers and Providers must promptly report:
Accidents or collisions
Vehicle theft or loss
Mechanical failures
Safety incidents
Any significant vehicle-related issue
IvA may request supporting documentation, photos, or other evidence when investigating reported incidents.
8. Account Suspension & Termination
IvA may suspend, restrict, or terminate your account if you:
Violate these Terms
Provide false or misleading information
Engage in fraudulent or unlawful activity
Fail to make required payments
Abuse other users, Providers, or IvA staff
Create a safety or security risk
You may request account deletion by contacting us. Some data may be retained as required by law. Termination does not remove obligations that arose before it.
9. Prohibited Activities
Users must not:
Use IvA for unlawful purposes
Create fake accounts or impersonate others
Manipulate bookings, reviews, or payments
Attempt to bypass platform fees or security
Harass, threaten, or discriminate against other users
Upload malicious content or attempt unauthorized system access
Use another person's account without permission
10. Platform Role
IvA provides technology that connects customers with independent Providers. Unless expressly stated, IvA does not own or operate every vehicle or service offered through the platform. Provider-supplied information is displayed on the platform, and while we take reasonable steps to verify it, users should exercise their own judgment before confirming a booking.
11. Intellectual Property
All IvA branding, software, design, content, and trademarks are owned by or licensed to IvA and protected under applicable intellectual property law. You may not copy, modify, reproduce, sell, or commercially exploit any IvA content without prior written permission.
12. User-Generated Content
If you submit ratings, reviews, or other content, you confirm it is accurate, lawful, and does not violate anyone's rights. By submitting content, you grant IvA a non-exclusive license to use, display, and distribute it for operating and improving the platform.
13. Limitation of Liability
To the fullest extent permitted by law, IvA is not liable for indirect, incidental, or consequential losses arising from your use of the platform or services. IvA does not guarantee uninterrupted platform availability. Nothing in these Terms excludes liability that cannot legally be excluded.
14. Third-Party Services
IvA integrates with third-party services such as payment processors, maps, and cloud providers. These services operate under their own terms and privacy policies. IvA is not responsible for third-party services beyond what is required by applicable law.
15. Changes to Terms
We may update these Terms periodically. Changes will be communicated via the app or email. Continued use of IvA after an update constitutes acceptance of the revised Terms.
16. Governing Law
These Terms are governed by the laws of India. Any disputes arising from these Terms shall be subject to the jurisdiction of the competent courts in India.
